Terms of Service

These Terms of Service (“Terms”) govern your access to and use of Notalyn (“we,” “our,” “us”), operated by RAE Kersten, registered in the Netherlands.
By accessing or using Notalyn, you agree to be bound by these Terms.

1. Overview

Notalyn is a SaaS platform that transforms Notion documentation into guided, trackable onboarding flows. Users can connect their Notion workspace, convert existing pages into interactive learning experiences, assign and track learners, and measure onboarding progress across teams.

2. Account & Access

• You must create an account to use Notalyn.

• You are responsible for maintaining the security of your account credentials.

• We may suspend or terminate accounts that violate these Terms, misuse the platform, or fail to make payments.

• You may cancel your account at any time; cancellation will prevent future billing but does not grant refunds for past payments.

3. Plans & Payments

• Notalyn offers one paid plan, available on a monthly or annual basis.

• Payments are processed securely through Stripe.

• No refunds are provided once a payment has been processed.

• You can cancel anytime, and your subscription will remain active until the end of the current billing period.

• All fees are exclusive of taxes unless otherwise stated.

4. Acceptable Use

You agree not to:

• Use Notalyn for unlawful or harmful purposes.

• Attempt to disrupt, reverse-engineer, or gain unauthorized access to the platform.

• Upload or distribute malicious code or data.

• Misuse integrations or APIs (e.g., Notion, Mailgun) in violation of their own terms.

We reserve the right to suspend or terminate access for behavior that compromises security, service integrity, or other users’ experience.

5. Data & Privacy

• We collect and store limited data such as user names, emails, and learner progress.

• Data is securely hosted on Supabase.

• We do not sell or share user data with third parties.

• Our Privacy Policy (separate document) explains how data is handled in detail.

6. Integrations

Notalyn integrates with third-party services such as Notion and Mailgun.
Your use of these integrations is also subject to their respective terms and policies.
We are not responsible for service interruptions or data issues caused by third-party platforms.

7. Intellectual Property

All platform code, design, and content are the exclusive property of RAE Kersten.
Users retain rights to their own imported or created content but grant Notalyn a limited license to process and display it within the platform.
No white-labeling, sublicensing, or reselling of the Notalyn brand or product is permitted.

8. Beta Use

Notalyn may offer early-access or beta features.
These are provided “as is” and may change or be discontinued at any time.
You acknowledge that beta functionality may be less stable and accept any associated risks.

9. Disclaimers & Limitation of Liability

• The platform is provided “as is” without warranties of any kind.

• We do not guarantee uninterrupted or error-free operation.

• To the fullest extent permitted by law, RAE Kersten is not liable for any indirect, incidental, or consequential damages arising from your use of Notalyn.

• Our total liability will not exceed the amount paid by you in the twelve (12) months preceding the claim.

10. Termination

We may terminate or suspend access immediately, without prior notice, if you breach these Terms or fail to pay.
Upon termination, your right to use the Service will end, and we may delete associated data according to our retention policy.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of the Netherlands, without regard to conflict of law principles.
Any disputes shall be handled in Dutch or EU jurisdictional courts.

12. Changes to These Terms

We may update these Terms occasionally.
The latest version will always be available at notalyn.io.
Continued use of the platform after updates constitutes acceptance of the new Terms.
